These Terms & Conditions (“Terms”) govern your access to and use of the keteGara website, mobile applications, and related services (collectively referred to as the “Platform”).

By accessing, downloading, installing, or using the Platform, you agree to be legally bound by these Terms, our Privacy Policy, Cancellation & Refund Policy, and any other policies published on the Platform from time to time.

If you do not agree with these Terms, please do not use the Platform and uninstall the mobile application immediately.

keteGara is a digital multi-vendor marketplace operated by Harvey&Co, designed to connect merchants, businesses, artisans, and customers through a secure online commerce ecosystem.

The Platform may only be used by:

1. Individuals aged 18 years or older
2. Registered legal entities such as companies or organizations

USE OF THE PLATFORM

keteGara operates solely as a technology platform and marketplace facilitator. All commercial and contractual terms related to products and services are agreed directly between Buyers and Merchants.

These terms may include:

1. Product pricing
2. Taxes
3. Shipping costs
4. Delivery methods
5. Payment terms
6. Warranties
7. After-sales services

keteGara does not manufacture, own, sell, or physically possess the products listed by Merchants on the Platform.

While keteGara may provide support services such as:

1. Logistics coordination
2. Delivery services via CoursierPlus
3. Payment collection
4. Customer support
5. Order management assistance

keteGara is not responsible for:

1. Product quality issues
2. Incorrect products delivered by merchants
3. Delays caused by merchants
4. Product unavailability
5. Out-of-stock items
6. Merchant non-performance
7. Any direct dispute between Buyers and Merchants

All product descriptions, pricing, images, and availability displayed on the Platform are provided by the Merchants. Product images are for illustrative purposes only and may differ slightly from the actual products delivered.

DELIVERY SERVICES

Delivery services are powered by coursierPlus and affiliated logistics partners.

Estimated delivery times are approximate and may vary depending on:

1. Merchant preparation time
2. Traffic conditions
3. Weather conditions
4. Location accessibility
5. Operational constraints

keteGara shall not be held liable for delays caused by merchants, force majeure events, or circumstances beyond reasonable control.

Orders will only be delivered to the address provided at the time of purchase. Customers are responsible for:

1. Providing accurate delivery information
2. Remaining reachable during delivery
3. Providing any necessary directions or authorization

Failure to accept delivery may result in:

1. Additional delivery charges
2. Cancellation without refund
3. Re-delivery fees

Once an order has been successfully delivered, responsibility and risk related to the goods transfer to the customer.

PAYMENTS

keteGara supports secure payment methods including:

1. Mobile Money
2. Credit/Debit Cards
3. Approved third-party payment gateways

By making a payment, you confirm that:

1. You are authorized to use the selected payment method
2. All payment information provided is accurate and lawful

keteGara does not directly store your credit or debit card details. Payment information may be securely processed and stored by authorized third-party payment providers.

We reserve the right to:

1. Add or remove payment methods
2. Refuse suspicious transactions
3. Conduct fraud verification checks
4. Suspend transactions that violate applicable laws

Refunds, cancellations, and dispute resolutions shall be handled according to our Refund & Cancellation Policy.

USER ACCOUNTS & PERSONAL INFORMATION

To access certain services, users may be required to create an account and provide personal information including:

3. Email address
4. Delivery information

Users are responsible for maintaining the confidentiality of their account credentials and for all activities conducted through their accounts.

PROHIBITED ACTIVITIES

Users agree not to engage in activities that violate laws, regulations, or the integrity of the Platform.

Prohibited activities include, but are not limited to:

1. Fraudulent transactions
2. Posting false or misleading information
3. Violating intellectual property rights
4. Uploading abusive, hateful, defamatory, or illegal content
5. Harassment or cyberbullying
6. Impersonating another person or business
7. Distributing spam or malicious content
8. Attempting unauthorized access to the Platform
9. Interfering with the operation or security of the Platform
10. Collecting user data without consent
11. Promoting illegal products or activities

keteGara reserves the right to:

1. Suspend or terminate accounts
2. Remove content
3. Restrict access to the Platform
4. Report unlawful activities to authorities
5. Take legal action where necessary

CANCELLATION POLICY

keteGara reserves the right to cancel orders in cases including but not limited to:

1. Product unavailability
2. Delivery location outside coverage areas
3. Pricing errors
4. Fraud suspicion
5. Technical issues
6. Force majeure events

Customers may also request cancellations subject to merchant approval and the status of the order.

Refund eligibility will depend on the circumstances and applicable refund policies.

AMENDMENTS TO TERMS

KeteGara reserves the right to modify or update these Terms at any time without prior notice.

Updated Terms become effective immediately upon publication on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

Users are encouraged to review these Terms regularly.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, KeteGara shall not be liable for:

1. Indirect or consequential damages
2. Loss of profits or business opportunities
3. Merchant misconduct
4. Product defects
5. Delivery delays beyond reasonable control
6. Service interruptions
7. Unauthorized account access caused by user negligence

The Platform and services are provided on an “as is” and “as available” basis without warranties of any kind.

GOVERNING LAW

These Terms shall be governed and interpreted in accordance with the laws applicable in the Central African Republic.

Any disputes arising from the use of the Platform shall be subject to the jurisdiction of the competent courts of Bangui, unless otherwise required by applicable law.
